Judge Rides Short Bus

We already knew that some judges make stupid decisions. After all, abortion is legal in this country and Terry Schiavo is dead, just to name a few.

But a recent decision by Cheyenne County (Nebraska) District Judge Kristine Cecava might go down as one of the dumbest ones ever after she sentenced Richard W. Thompson to 10 years probation for sexually assaulting a 12-year-old girl on multiple occasions instead of a 10-year prison term because Thompson is 5-foot-1 and Cecava felt that he was too small to survive in a state prison.

It was such a bizarre ruling that it even took the ACLU by surprise. Amy Miller, legal director of the Nebraska chapter of the far-Leftist "civil liberties" group, said that she "have never heard of anything like this before" regarding using height as a means of discrimination.

It might be because there is nothing in the United States of Nebraska Constitutions about how the physical buildup of one's body besides race and sex can provide some sort of protection. Heck, even the local prison system said that there are short people inmates and they can be some of the toughest folks around.

Maybe Judge Cecava was high or drunk or something else when she delivered her verdict. After all, how in heaven's name could she have made such a bonehead ruling? Since when did this country allow free passes to people based on how a person is physically built? Should Yao Ming be allowed to commit a crime because he is 7-foot-6 and may be too tall for some inmates to accept? Or how about giving a free pass to a handicapped guy because he needs a cane to walk and just because he shot someone doesn't mean that he should have to suffer the hard, painful treatment he might get from the folks in prison. Boo-hoo. Cry a tear now, America.

Or maybe they're just trying to find a way to make sure that Mini Me doesn't get charged for the crimes he committed while working with Dr. Evil. It would certainly make sense to me.

Nebraska senator summed up the situation pretty well when he said, "If shortness is an excuse and protection from going to prison, short people ought to rob banks and do everything else they would wind up going to prison for," Chambers said. "We're talking here about a crime committed against a child, and shortness is not a defense."
